Terms Of Agreement

1. Check-in time is 2 pm. and Check-out time is 11:00 am. Depending on the schedule, this may be flexible on a case by case basis.
2. The Landlord or his agent has the right to inspect the premises without prior notice at any time. Should the Occupant(s) violate any of the terms of the agreement, the rental period shall be terminated immediately with no refund for unused days.
3. The Occupant(s) shall maintain the premises in good, clean condition, and use the premises only in a careful and lawful manner. 
4. Only registered guests are allowed to stay overnight (11 pm.-6 am.) on the premises.  The landlord must be informed of additional occupants.

5. Lost keys are subject to a $20 fee.
6. The Occupant(s) shall behave in a civilized manner and shall be good neighbors, respecting the rights of the surrounding guests, especially regarding music or loud noises after 9:00 PM.
7. There shall be no smoking inside the house and no pets accompanying occupants. 
8. Matapalo is a wildlife sanctuary area. The occupant will not bring dogs with them or allow area dogs or cats inside the house or feed them on Casa Bambu property. 
9. The Landlord shall provide bath towels, face cloths, linens and kitchen/bathroom paper supplies throughout the rental period. Occupant(s) may use any such consumables at the premises. Should Occupant need consumables in addition to what is at the premises, Occupant is responsible for purchasing such consumables.
10. Extensive house cleaning (including bathrooms and kitchen), plus change of bath towels, is provided every 3 days.  Linens are changed once a week unless requested earlier. Laundry service is not included in the rental rate, but available upon request for an additional fee.
11. We occasionally experience outages or malfunctions beyond our control. No refunds or compensation will be given in this case. Please inform us immediately should you experience any outages or malfunctions during your stay and we will remedy the situation as quickly as possible.
12. Balance for the full amount must be received one month before arrival. Reservations cancelled more than 30 days before arrival are refundable minus a $75 processing fee. Reservations cancelled 30 days or less before start of stay are refundable, less a $75 processing fee, only if we are able to re-rent the premises for the same time period. No refunds are issued for early departure or late arrival due to inclement weather or personal circumstances.  In all cancellation circumstances, lodging tax will be fully refunded.
13. The occupant will reimburse Landlord $100 for lost boogie boards to cover replacement charges of buying and shipping from the US.
14. Jet skis are not allowed on Casa Bambu S.A. property.
15. Unfortunately, in the last few years, the white faced monkeys, Capuchins, have been corrupted by humans.  Only a few years ago they did not enter the houses. They, like the other three species of monkey that grace the forest of Matapalo, were curious about us, but they never entered a house or approached a human.  Three years ago, unbeknownst to our staff, some very thoughtless people staying in Casa Linda fed Capuchin monkeys by hand from the front porch during their week long stay.  This changed the Capuchin’s behavior radically. They overcame their natural avoidance of humans. They will now enter the houses and steal food wherever they find it. We are doing everything we can to erase this unnatural behavior from their memories.  Please help us restore the monkeys to their primal state. Do not feed any monkeys or allow anyone in your group to feed them. We will send simple instructions regarding food storage so you can help us teach the monkeys that our houses are not a food source and easily avoid having your food stolen by the pesky Capuchins.  We are committed to the preservation of Matapalo’s unique primal rain forest state and are making this request a condition of the rental agreement.

16. The Occupant(s) and any guests shall hereby indemnify and hold harmless the Landlord against any and all claims of personal injury or property damage or loss from use of the premises or participation in any tours or area activities, regardless of the nature of the accident, injury or loss. Occupant(s) expressly recognize that any insurance for property damage or loss which the Landlord may maintain on the property does not cover the personal property of the Occupant(s) and that Occupant(s) should purchase their own insurance for Occupant(s) if such coverage is desired.
17. It is our goal to make your vacation an unforgettable trip.  To ensure that our goal is met, we refer guests to professional tour companies to expose them to the many wonders of the area.  We are not affiliated with any tour company and cannot be responsible for guests’ experiences, satisfaction or safety while on a tour or activity.  By signing this agreement, you acknowledge and agree that many area activities and tours entail risk and could possibly result in severe injury or even death.  Knowing the risks of these activities, you freely accept responsibility in performing them and for visiting the Matapalo area and Casa Bambu property. By signing this agreement, you acknowledge the risks involved and agree not to hold liable the private owners of Casa Bambu, LLC for any injury or other results that may occur.  

18. Parents/guardians are responsible for minor(s) in their care.

19.Privacy Policy

Information and its use:

When purchasing our products and services, or simply signing up for our e-mail newsletter, you are required to enter personal details which may include:

• Your name
• Email address
• Postal address
• Phone numbers
• Debit or credit card details

We collect the information from you in order to:

• Provide complete access to our website
• Register as an authorized user on our website
• Inform you about all the latest deals and other information relevant to you. All information will be delivered by e-mail.

You can choose not to provide certain information, but in so choosing you may not be able to take advantage of many of our features. We use the information that you provide for such purposes as responding to your requests, customizing future experiences for you, improving our operations, and communicating with you.

You can visit our website, read materials, and browse the website’s contents without giving us any personally identifiable information. In order to provide you with the most efficient and enhanced personalized service and attention, we collect certain information automatically.

Updating or Deleting Your Personally Identifiable Information

Under law, you may exercise various rights regarding your Personally Identifiable Information (PII). You may request a copy of your PII to ensure that it is current and correct, elect whether or not to receive marketing or other communications from us or partners, and request that we delete your PII or provide you with a copy of your PII.

For inquiries about these rights, or as a means of exercising them, please reach out via e-mail to info.casabambucom. If you are located in the European Union or European Economic Area, these rights are not exclusive of any rights available under the GDPR.

Responses will be issued within the statutorily-required period. In the event of deletion, unfortunately, some residual information will remain within our databases, access logs, and other records, which could contain your PII.

Some PII may be exempt from such requests under particular circumstances, such as if we must continue processing your PII to comply with a legal obligation. When you email us with a request, we require sufficient identifying information to ensure the individual issuing the request is in fact the individual to whom the information belongs.

General Data Protection Regulation

If you are in the European Union (EU), you have specific rights under the General Data Protection Regulation (GDPR). If you choose to provide us with information, you may ask us at any time to delete the information, with which we will comply in a reasonably timely manner if we have not independently chosen to delete the same information prior to your request. In either case, you will be advised accordingly.

You may request a copy of any computer file compiling your information, to the extent we have collected it, and such file will be provided to you in a commercially reasonable period if it has not been previously deleted, as noted above.

You may ask us not to process your data, or to share it with any entities that would do so. Please note, however, that there is no known sharing of any data by our company with third parties, and outside of the unlikely possibility of subpoena, other court order, or legally compliant government investigation, nor desire to do so.

If you have consented to the processing of your personal data, you may withdraw that consent at any time – though please note that processing that had occurred prior to such withdrawal would remain legal in retrospect.

The information that is asked from you is intended only to fulfil the requirements to form a contract, and no additional information gathering or processing will be required than must be for that purpose.

If you believe that our company has failed to adhere to your rights under the GDPR, you are entitled to file a complaint with the relevant supervisory authority.

Our company does not, to the extent that the term can be reasonably understood, engage in large-scale data collection or processing, and so does not have an appointed specialist Data Protection Officer or employ any representative physically located in the EU and designated as the point of contact for the EU government on these matters.

How We Collect and Use Information

Log Files. When you visit our website, the information from your website is automatically gathered by our servers from your browser. The information includes your IP address, browser specifications, Internet service provider you use, pages you visit, type of platform and the number of clicks. By doing this we analyze trends and brands, prevent fraud, gather demographic info and many more. We do not share the log files and they are safe.

Cookies. When you are visiting our site or using our Services we use “cookies” to track some information. Cookies are actually extremely small files that are placed on your computer. They allow us to keep track of the number of visitors and to recognize the repeat visitors from the new ones. Furthermore, cookies allow us to save user preferences and at the same time to keep track of the current user trends. Any User that rejects the use of cookies assumes all the responsibilities for any possible loss. The cookies are not linked to any Personally Identifiable Information (“PII”). 

What Types of Cookies does casabambu.com Use? 

We use first person, second person, session, flash and persistent cookies. When delivering special content such as video clips or animation, we may use Adobe Flash Player. These cookies, also known as local shared objects, are used to improve your browsing experience by remembering your preferences and settings. These cookies are managed by an interface different from your web browser and are stored on your device. You cannot manage flash cookies through your web browser the same way as other cookies. The time a cookie stays on your browsing device depends on if it is a “session” or “persistent” cookie. Persistent cookies are stored until they are deleted or expire. Session cookies are stored until you stop browsing.

Web Beacons. “Web beacons” are often used together with cookies to personalize the website for our users. They are also used to collect a small amount of information about our visitors. Web beacons, that are also called “clear gifs” or “pixel tags” are actually small graphic images that are transparent. Also, the use of Web beacons is sometimes through email in order of understanding the behavior of our Users. Web beacons are not linked to any PII.

Mobile Analytics. 

For a better understanding of the functions of our mobile software, we use mobile analytics. Mobile Analytics might keep track of some information. These include how often you use the application, all the events that happen within the using of the application, the amount of usage, data about the performance of the application and where was it downloaded from. We don’t link any info that we store through mobile analytics software to any PII.

Telephone: We may contact you personally if we feel there’s some issue regarding your membership or even answer your queries. 

Email: We reserve the rights to send emails to those who signed up on our website or posted any query. We will never spam you. If you are interested in not receiving any email from us, you can always unsubscribe us. All the emails are sent by our company and we don’t share your personal details with third-party sites. You may unsubscribe to any of our online e-mail updates by following the unsubscribe instructions in the body of any e-mail message. We will take commercially reasonable steps to implement your opt-out requests promptly, but you may still receive promotional information from us for up to 21 days.

Changes to Our Privacy Policy

We reserve the right to modify or make adjustments in this privacy policy without prior notice. Should any of these changes generate an error or discrepancy, you, as the user, agree that the website and its company shall not be held liable for any damages caused by said issue. Our website and the servers that make this website available worldwide are located in the United States. The Internet laws in the United States govern all matters relating to this website. Any information you provide in subscribing to our website or registering or ordering at our website will be transferred to the United States. By visiting our website and submitting information, you authorize this transfer, processing and use.

We incorporate standard industry practices internally and with our service providers, which we believe suits the degree of sensitivity of the information involved to maintain the security of your personal information and to avoid its disclosure except as described in this Privacy Policy.

Although we have implemented systems and procedures to secure the data maintained by us, security during Internet transmissions can never be assured. Our policy is to limit access to personal data to those employees or agents with a specific need to access or retrieve this information. Termination

We reserve the right to terminate or cancel your account if we notice any inappropriate behavior or breach to our terms or privacy policy.
